DrayNow, Inc. (“DrayNow”, “us”, “we”, or “our”) respects your privacy. This Privacy Policy describes the types of information we may collect from users, including you, and our practices for collecting, using, maintaining, protecting and disclosing that information. This Privacy Policy applies to information we collect via the DrayNow website at www.DrayNow.com (the “Site”) and the associated mobile application (“Mobile App”) (the Site, Mobile App and all services provided therein are hereinafter collectively referred to as the “Service”). This Privacy Policy does not apply to all information that we collect offline or that you provide to or is collected by any third party.

Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we will treat it. By accessing or using the Service, you represent and warrant that you have read and understand the terms of this Privacy Policy and the related Terms of Use available at www.draynow.com, and that you accept and consent to the privacy practices (including any uses and disclosures of information about you) described in this Privacy Policy and the terms in the Terms of Use. If you do not agree with all of the provisions of this Privacy Policy or Terms of Use, do not access or use the Service.

The Service is not intended for use by children under thirteen years of age. If you are under the age of thirteen, you may not access or use the Service (which includes downloading and using the Mobile App). If you are aware of any use of the Service by a child under the age of thirteen, please inform us immediately so that we can terminate such usage.

Information We Collect and How We Collect It

A. Information Collected

  1. Personal Information. You may browse the Site without disclosing any personal information. If, however, you access or use the Service (including the Mobile App), whether as a customer, carrier, driver, or otherwise, you may be required to provide information that will allow us to facilitate such access or use, which information may include, without limitation: any information that may be used to identify an individual (“Personal Information”), including, but not limited to, a name, company name, postal address, business name and information, a driver’s license number, a telephone number, an email address, and credit card information. With respect to Carriers, such information may also include but is not limited to motor carrier authority information (e.g., federal or state motor carrier numbers) and documentation (e.g., certificates of insurance, motor carrier authority permits or certificates, and safety-related documents). You acknowledge that your access and use of certain portions of the Service is conditioned on your provision of such Personal Information. You may decline to share certain Personal Information with us, in which case we may not be able to provide to you some of the features and functionality of the Service.
  2. Device Information. When you download, access, and use the Service (including the Mobile App), it may use automated technology to collect information that is sent to us automatically regarding your computer or mobile device and internet connection, including the device’s unique device identifier, IP address, operating system, browser type, mobile network information and the device’s telephone number.
  3. Usage Information. DrayNow may use technologies that collect and store certain data about the use of the Service by you and other users on an aggregate or anonymous basis, including but not limited to selections you make on the Mobile App or the Site, features you use, preferences you set, general physical location, and other information collected as further described in this Privacy Policy. This information may be non-identifying. If information collected regarding your usage of the Service is associated or linked with your personal information, we will treat such usage information as personal information.
  4. Location Information. The Mobile App collects real-time information about the physical location of the device through which you access and use the Service. This location information is used for various purposes, including but not limited to, notifying carriers and drivers of available shipments at nearby locations, determining delivery times and conveying such information to customers and consignees, and improving the Service.
  5. Voluntary Provision of Information. We may collect or process personal information that you provide voluntarily to us directly or indirectly.

B. Information Collection Technologies

We collect information from and about users of our Service directly from you when you provide it to us, and automatically when you use the Service (including the Mobile App). The technologies we use for automatic information collection may include:

  1. Cookies. A cookie is a small file placed on your computer, smartphone, or other device used to access or use the Service. If you do not want information to be collected through the use of cookies, you may be able to refuse to accept cookies by activating the appropriate setting on your computer, smartphone, or other applicable device. However, if you select this setting you may be unable to access certain features of the Service.
  2. Web Beacons. Pages of the Site, Mobile App, and our email communications may contain small electronic files known as web beacons (also referred to as clear gifs, pixel tags and single-pixel gifs) that permit us to, for example, count users who have visited those pages or opened an email and for other related Service statistics (for example, recording the popularity of certain Mobile App content and verifying system and server integrity).

C. CCPA Categories

The categories described below explain the Personal Information we may have collected over the past twelve (12) months, or may collect in the future, about you, depending on your use of the Site, Services, or Mobile App.

Non-Sensitive Personal Information

Identifiers Identifiers such as a real name, alias, postal address, unique personal identifier, online identifier, Internet Protocol address, email address, account name, social security number, driver’s license number, passport number, or other similar identifiers.
Communications Your communications, including e-mails, Site submissions and messages, with us.
Internet Activity Information relating to your use of the Site, including IP address, cookies, device information, and other related information.
Education Information Information derived from your resume or otherwise provided by you, including records of education history, student records or transcripts, or other related records.
Professional or Employment-Related Information Information derived from your resume or otherwise provided by you, including work history, human resources, benefits, insurance, administrative records, recommendations, or other related information.
Audio, electronic, visual, thermal, olfactory, or similar information Photographs may be voluntarily provided for certain business purposes. Video footage of driver and truck surroundings upon initiation of safety system if you are hired for a business purpose as a driver.
Geolocation Data Any data that is derived from a device and that is used or intended to be used to locate a consumer within a geographic area that is not considered precise geolocation data.

Sensitive Personal Information

Category Specific Examples
Government Issued Identifiers Your social security number, driver’s license, state identification card, or passport number.
Precise Geolocation Any data that is derived from a device and that is used or intended to be used to locate a consumer within a geographic area that is equal to or less than the area of a circle with a radius of 1,850 feet, except as prescribed by regulations. For drivers with active shipments, this includes continuous background location data collected when the Mobile App is running in the background and is not the active foreground application on the driver’s device. Drivers are required to enable “Always Allow” (iOS) or “Allow all the time” (Android) location permission as a condition of using the Service as the continuing collection of background location data is necessary for accurate tracking Shipments.
Financial Information Your account log-in, financial account, debit card, or credit card number in combination with any required security or access code, password, or credentials allowing access to an account.
Health Information Your medical history and the results of a United States Department of Transportation physical and/or drug test, if you are hired for a business purpose.
Characteristics of Protected Classifications under California or federal law Your racial or ethnic origin, religious or philosophical beliefs, or union membership.

How We Use Your Information

We use information the information we collect about you or that you provide to us, including any Personal Information, to:

  • Operate, maintain, and provide the Service (including the Mobile App);
  • We may collect precise geolocation data from users of the Mobile App including drivers to comply with best practices, contracts, and to provide tracking services for delivered goods. Specifically, when a driver has an active Shipment, the Mobile App collects continuous, precise location data from the driver’s mobile device, including when the Mobile App is running in the background and is not the active foreground application on the driver’s device (“Background Location”). Drivers are required to grant “Always Allow” location permission (iOS) or “Allow all the time” location permission (Android) as a condition of using the Service and accepting Shipments, as set forth in the Terms and Conditions. Failure to maintain this permission level will result in interruption of location tracking and may result in suspension of access to the Mobile App or Service;
  • We also use the collected data for legal, compliance, and risk-management purposes, including complying with applicable laws, regulations, court orders, and governmental requests;
  • Engage third-party service providers to perform transportation services;
  • Process registration with the Service and open, maintain, and close accounts;
  • Provide you with information, communications, etc. relevant to your use of the Service;
  • Notify you when Mobile App or other Service updates are available, and of changes to any products or services we offer or provide though the Service;
  • Improve, expand, and troubleshoot the Service;
  • Provide customized content and information;
  • Use for internal business purposes;
  • Enforce the Terms and Conditions;
  • Conduct billing and collection; and
  • Fulfill any other use disclosed at the time you provide your information or as described in this Privacy Policy.

Disclosure of Your Information

We may disclose de-identified or aggregated information about our users, and information that does not identify any individual or device, for business purposes without restriction. Such information is not considered to be personal information.

In addition, we may disclose Personal Information that we collect or you provide:

  • To other users of the Service as necessary to facilitate the services. For example, certain information regarding a Carrier may be disclosed to a Customer whose load the Carrier has agreed to transport (and vice versa) as necessary to facilitate the provision and completion of that transportation;
  • To our subsidiaries and affiliates, for the purpose of providing the Service, any purpose described in this Privacy Policy or the Terms and Conditions, or for any other lawful purpose;
  • To contractors, service providers and other third parties we use to support our business and who are bound by contractual obligations to keep personal information confidential and use it only for the purposes for which we disclose it to them;
  • To a buyer or other successor in the event of a merger, divestiture, restructuring, reorganization, dissolution or other sale or transfer of some or all of DrayNow’s assets, whether as a going concern or as part of bankruptcy, liquidation or similar proceeding, in which personal information held by DrayNow about our Service users is among the assets transferred;
  • To fulfill the purpose for which you provide it;
  • For any other purpose disclosed by us when you provide the information;
  • For any other business purpose;
  • With your consent;
  • If required to do so to comply with any court order, law or legal process (including to respond to any government or regulatory request), or in the good-faith belief that such disclosure is so required;
  • To enforce our rights arising from any contracts entered into between you and us, including the Terms and Conditions, and for billing and collection; and
  • If we believe disclosure is necessary or appropriate to protect the rights, property, or safety of DrayNow, our customers or others. This includes exchanging information with other companies and organizations for the purposes of fraud protection and credit risk reduction.

We do not sell, share, rent or trade Personal Information we have collected about you. We do not share your Personal Information with third parties for those third parties’ direct marketing purposes unless you consent to such sharing at the time you provide your Personal Information.

You hereby assign to DrayNow all rights in any feedback, suggestions, reports of system errors, and other information or ideas regarding the Service you provide to DrayNow (“Feedback”) and agree that DrayNow shall have the right to use such Feedback and related information in any manner it deems appropriate. Without limiting the foregoing, this assignment of rights applies to any testimonials you provide, and you hereby also grant us the right to use your name in connection with sharing such testimonials with the public. We will treat any Feedback you provide to us as non-confidential and non-proprietary. You agree that you will not submit to us any information or ideas that you consider to be confidential or proprietary. If you agree to participate in any case studies, you agree that information you provide in connection with the case study is deemed Feedback and that we may use your name in connection with such Feedback.

Data Security

We have implemented commercially reasonable measures designed to secure your Personal Information from accidental loss and from unauthorized access, use, alteration and disclosure.

The safety and security of your Personal Information also depends on you. You are responsible for maintaining the confidentiality of the login credentials we have given you (or you have chosen) to access to certain parts of the Service. Do not to share your password with anyone, and we urge you to be careful about giving out information in any public areas of the Site or Mobile App. Any information you include in a publicly-accessible area of the Service will be available to anyone who has access to that content, including other users of the Service. If you delete your User Content from the Site or Mobile App, copies of such User Content may remain viewable in cached and archived pages, or might have been copied or stored by other Service users.

You also agree and are obligated to maintain the confidentiality of any personal information of any other user of the Service that you receive from us (or otherwise obtain) for purposes of facilitating the services you provide or receive using the Service.

Unfortunately, the transmission of information via the internet and mobile platforms is not completely secure. Although we have implemented measures designed to secure your Personal Information, we cannot guarantee the security of your Personal Information transmitted through our Service. Any transmission of Personal Information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures we provide.

Data Retention

DrayNow will retain your personal information, including sensitive personal information for no longer than is reasonably necessary for the purposes stated in this Privacy Policy including for legitimate business purposes unless otherwise required or permitted by law.

If you are involved in any litigation related to DrayNow, then DrayNow reserves the right to preserve your information. After the time dictated by law or when the business purpose is fulfilled, the data will be deleted, unless otherwise required to be retained for legal, compliance, or operational reasons. Historical data will be archived according to the timelines set forth by federal law and used for historical report, analysis, and compliance purposes after which it will be deleted in accordance with our data destruction policy.

Ongoing Communications

The Service may provide you with the opportunity to elect to receive future communications about DrayNow products and services. If you authorize these communications, we may contact you periodically with such information. However, if you later change your mind and would no longer like to continue receiving such communications, please contact us (our contact information is listed below) and let us know that you would like to be removed from all further communications (or, if available, click the link at the bottom of any email you receive from us and follow the instructions). Please allow us a reasonable period of time to complete your request.

International Use

The Service is hosted in the United States. If you use the Service from a region other than the United States, you acknowledge that you are transferring your personal information from that region to the United States for storage and processing. By providing any information, including personal information, on or to the Service, you consent to such transfer, storage, and processing.

Children Not Intended Users of Service

Our Service is intended for adults. If you are under the age of sixteen, disconnect from the Service immediately and cease use. We do not knowingly collect personally identifiable information from children. If you are a parent or legal guardian and think your child under sixteen has given us information, please email us at the e-mail address listed at the end of this Privacy Policy. Please mark your inquiries “COPPA Information Request.” To the extent that DrayNow receives any information for children under the age of sixteen, DrayNow shall follow all applicable laws and will not sell such data.

State Rights

DrayNow may collect certain personal information as defined in the California Consumer Privacy Act of 2018 (the “CCPA”) and amended by the California Privacy Rights Act effective January 1, 2023 (the “CPRA” and referred to interchangeably with the CCPA). This Section details DrayNow’s collection of your personal information, and your rights under the CCPA. It may also detail rights provided under equivalent laws in other states. For avoidance of doubt, the rights stated in this Section shall only apply to California residents, or to residents of other states with equivalent rights, and solely to the extent that these rights are applicable.

California residents have the right to make the following requests regarding their rights under the CCPA to covered businesses. Information regarding how you can utilize your rights is contained in Section titled “Contact Us” of this Privacy Policy. These rights include:

  • Right To Know About Collection, Disclosure or Sale of Personal Information: You have the right to know what personal information DrayNow has collected about you as further detailed in this Privacy Policy. Specifically, you may request:
    1. The categories of personal information we have collected about you.
    2. The categories of sources from which the personal information is collected.
    3. The business or commercial purpose for collecting, selling, or sharing personal information.
    4. The categories of third parties to whom we disclose personal information.
    5. The specific pieces of personal information we have collected about you.
  • Right to Deletion of Personal Information: You have the right to request that DrayNow delete certain information we have collected from you.
  • Right to Opt-Out of the Sale or Sharing of Personal Information: You have the right to opt out of the sale or sharing of certain personal information. However, DrayNow does not knowingly sell your Personal Information or share your Personal Information other than as described herein.
  • Right to Non-Discrimination: You have the right not to receive discriminatory treatment by us for the exercise of privacy rights conferred by the CCPA.
  • Right to Correct Personal Information: You have the right to correct inaccurate information that we maintain about you.
  • Right to Opt-Out of Automated Decision Making: You have the right to opt out of automated decision making under certain circumstances.
  • Right to Limit Use and/or Disclosure of Sensitive Personal Information: Under certain circumstances, you have the right to limit the use or disclosure of sensitive personal information by DrayNow. DrayNow does not use your sensitive personal information except for defined business purposes.

DrayNow does not necessarily take any actions or collect any data from you in a manner that implicates your CCPA rights.

Changes to Our Privacy Policy

We may update this Privacy Policy from time to time. If we modify the Privacy Policy, we will make it available through the Service. All such modifications, updates, and amendments are effective immediately upon notice thereof, which we may give by any means, including, but not limited to, by posting a revised version of this Privacy Policy or other notice on the Site or Mobile App. We will endeavor to notify you of such changes via email or a message through the Service, but we are not obligated to do so and will not be liable for any failure to do so. You should view this Privacy Policy often to stay informed of changes that may affect you, as your continued use of the Service signifies your continuing consent to this Privacy Policy. This Privacy Policy is not intended to and does not create any contractual or other legal right in or on behalf of any party.

The date the privacy policy was last revised is identified at the bottom of this document. You are responsible for ensuring we have an up-to-date active and deliverable email address for you and for periodically visiting this privacy policy to check for any changes.
